Reasons adjustments are made to a jury's award

Wrongful death cases are not the easiest for people to handle because of the many emotions they may be experiencing during this time. In the midst of dealing with their loss, they must fight to recover damages and pick up the pieces. For many, things will not go back to normal, but with the help of the money they recover for damages, they can start to move on. Unfortunately, the final amount they receive from the liable party isn't determined by them, which means they could end up with more or less than they expected.

The following are reasons a judge may adjust the jury's award:

  • Decedent had poor money management.
  • Decedent had low earnings.
  • Decedent supported family.
  • Decent was unemployed.

Like many cases that go to trial, a wrongful death action is not different in that proof needs to be presented prior to damages being awarded to the family. Although the jury does examine the evidence and determine an award amount, a judge doesn't always have to agree with what they have found. This is not something that always occurs, but it is possible, so people should be prepared for this increase or decrease in the award.

Losing a loved one is not something people take lightly and it is not something they will ever forget. If a driver has been negligent and taken the life of another, there are consequences for these actions. Whether the family wants the person to go to jail or pay damages, hiring an attorney to assist them with filing a claim and the trial would be wise.
