Texting truck drivers can be held liable for accidents

The dangers of texting while driving are well known. Every year in Texas, many people are seriously injured or even killed in accidents caused by motorists engaged in this hazardous practice. And yet there are still many drivers who simply must avert their attention away from the road in order to read or send a text message.

Any motorist who texts while driving creates an unsafe situation for those with whom they are sharing the road. And if the texting motorist happens to be behind the wheel of a big rig truck, the situation goes from unsafe to downright life threatening.

Regulations established by the Federal Motor Carrier Safety Administration place specific limitations on texting for all drivers of commercial motor vehicles, including truck drivers. Simply put, truck drivers are strictly forbidden from texting while operating their trucks. If a driver is caught by the authorities in the act of texting while driving a truck, he or she could face a fine of up of $2,750.

Truck drivers who commit multiple violations of state texting laws could lose their commercial driving privilege for a period as long as 120 days. Moreover, any trucking company that requires or allows its drivers to use mobile devices for texting may be fined as much as $11,000.

But in spite of the dangers and the possible penalties, some truck drivers will still send and read texts while driving. But if doing so leads to an accident, that driver and possibly his or her employer should be held accountable.
